Terms and Conditions for Mulberry’s Painting and Decor

These Terms and Conditions (“Terms”) govern your use of Mulberry’s Painting and Decor services and website. By accessing our services, you agree to be bound by these Terms. Please read them carefully.

1. Definitions

  • “Mulberry’s” or “we/us/our”: Refers to Mulberry’s Painting and Decor, located at Unit 2F Cadcam Business Centre, Highforce Road, Middlesbrough, TS2 1RH, United Kingdom.
  • “Client” or “you”: Refers to any person or entity engaging our services.

2. Services Provided

Mulberry’s Painting and Decor offers professional painting and decoration services for residential, industrial and commercial spaces. Our services may include interior and exterior painting, wallpapering, decorative finishes, and other related decor services. Specific details, scope, and timelines for each project will be agreed upon in writing with each Client.

3. Quotations and Estimates

  • Quotations: All quotes provided by us are valid for 14 days from the date of issue. After this period, quotes may be subject to changes based on materials costs, availability, and other market factors.
  • Estimates: Estimates are based on our initial understanding of the project scope. Any additional work or changes requested by the Client may result in adjustments to the final price.

4. Booking and Deposits

  • Booking Confirmation: To confirm your booking, a written acceptance of the quotation is required.
  • Deposit: For certain projects, a deposit may be required before commencing work. This deposit will be clearly stated in the quotation and must be paid within the specified period to secure the booking.

5. Payment Terms

  • Invoicing: Invoices will be issued upon completion of work or as agreed upon in the project contract.
  • Payment Due: Full payment is required within 7 days of the invoice date, unless otherwise agreed upon.
  • Late Payment: In cases of late payment, Mulberry’s reserves the right to charge interest at the rate of 2.5% per day from the due date until payment is received in full.

6. Changes and Cancellations

  • Changes to Project Scope: Any changes or additional requests beyond the agreed scope must be communicated in writing. Mulberry’s will provide a revised estimate or quotation as needed.
  • Cancellations: If you need to cancel or postpone your project, please notify us at least 14 days in advance. Cancellations within this period may incur a cancellation fee, calculated based on any materials purchased or preparatory work completed.
  • Company Cancellations: Mulberry’s reserves the right to cancel a project due to unforeseen circumstances (e.g., force majeure events) or if the Client violates these Terms. In such cases, any deposits for work not completed will be refunded.

7. Client Responsibilities

Clients are responsible for:

  • Preparing the Area: Ensuring that areas to be decorated are clear of personal belongings, furniture, and obstacles. Mulberry’s may assist with moving items but is not liable for any damages to personal property in such cases.
  • Access to Premises: Providing access to the property as agreed for the duration of the project. If access is delayed, it may impact timelines and may incur additional charges.
  • Compliance with Laws: Ensuring that any necessary permits or approvals are obtained before project commencement.

8. Warranty and Liability

  • Warranty: Mulberry’s provides a 12-months warranty on workmanship for painting and decor services. This warranty does not cover damages resulting from natural wear and tear, accidents, misuse, or external factors beyond our control.
  • Limitation of Liability: To the fullest extent permitted by law, Mulberry’s shall not be liable for any indirect, incidental, or consequential damages. Our total liability is limited to the value of the services provided.
  • Indemnification: You agree to indemnify and hold Mulberry’s harmless from any claims, damages, or liabilities arising from your breach of these Terms.

9. Intellectual Property

All materials, images, and content provided on Mulberry’s website or in our marketing materials are the intellectual property of Mulberry’s Painting and Decor. Any unauthorised use, reproduction, or distribution of our content is prohibited.

10. Privacy

Mulberry’s Painting and Decor respects your privacy. Please refer to our Privacy Policy to understand how we collect, use, and protect your personal information.

11. Governing Law and Dispute Resolution

  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of England and Wales.
  • Dispute Resolution: In the event of a dispute, both parties agree to attempt resolution through informal negotiation. If no resolution is reached, disputes may be submitted to mediation or arbitration as agreed between the parties.

12. Amendments to Terms

Mulberry’s reserves the right to amend these Terms and Conditions at any time. The latest version of these Terms will be available on our website and will take effect immediately upon posting. Continued use of our services after any amendments indicates your acceptance of the updated Terms.
